END USER LICENSE AGREEMENT FOR DESKTOPSTREAMER SOFTWARE

GRANT OF LICENSE.
KTS InfoTech grants you the right to use one copy of the DesktopStreamer software program and documentation on a single computer. If you are using the evaluation version, you are allowed to use the product for the purpose of evaluating the product only.
COPYRIGHT.
DesktopStreamer software program and documentations are owned by KTS InfoTech and are protected by copyright laws and international treaty provisions. Therefore, you must treat this product like any other copyrighted material.
OTHER RESTRICTIONS.
You should not reverse engineer, decompile, disassemble, or modify DesktopStreamer software. This license is non-transferable.
KTS InfoTech or Project Partner or Authorized Distributor makes no warranty of any kind with regard to the merchantability, performances and fitness of the software for a particular purpose. KTS InfoTech or Authorized Distributor shall not be liable for errors or for incidental or consequential damages in connection with the performance, or use of the software. You shall remain solely responsible for, and hold KTS InfoTech or Authorized Distributor harmless from all claims, liability and damages arising from the use of DesktopStreamer software or its associated plugins developed by KTS InfoTech or Third party providers. Use the documents and software at your own risk.
USER RESPONSIBILITIES AND RESTRICTIONS.
You acknowledge that DesktopStreamer is a screen recording and streaming software that may capture, record, and stream audio, video, and screen content. You are solely responsible for:
- Ensuring compliance with all applicable laws, regulations, and privacy rights when recording, capturing, or streaming any content, including but not limited to obtaining necessary consents, permissions, and authorizations from all parties whose content, voice, image, or personal information may be recorded, captured, or streamed.
- Complying with all applicable copyright, intellectual property, privacy, and data protection laws when using the software to record, capture, or stream any content.
- Ensuring that any content recorded, captured, or streamed using DesktopStreamer does not infringe upon the rights of any third party, including but not limited to copyright, trademark, privacy, publicity, or other intellectual property rights.
- Verifying that you have the legal right and authority to record, capture, or stream any audio, video, screen content, or other material using the software.
- Complying with all terms of service, terms of use, and community guidelines of any streaming platforms, cloud storage services, or third-party services that you use in connection with DesktopStreamer.
- Ensuring that any use of the software's streaming features, cloud storage integration, or network connectivity features complies with all applicable laws and regulations.
KTS InfoTech or Authorized Distributor shall not be liable for any unauthorized recording, capture, or streaming of content, any violation of privacy rights, any copyright infringement, or any other illegal or unauthorized use of the software by you or any third party. You agree to indemnify and hold harmless KTS InfoTech, its officers, directors, employees, agents, Project Partners, and Authorized Distributors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of DesktopStreamer software.
THIRD-PARTY COMPONENTS AND SERVICES.
DesktopStreamer may include or utilize third-party components, libraries, services, or technologies (including but not limited to FFmpeg, OpenSSL, streaming protocols, cloud storage services, and other third-party software). KTS InfoTech makes no warranties or representations regarding such third-party components or services. Your use of any third-party components or services is subject to their respective terms and conditions, and KTS InfoTech shall not be liable for any issues, damages, or liabilities arising from such third-party components or services.
LIMITATION OF LIABILITY.
IN NO EVENT SHALL KTS INFOTECH, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PROJECT PARTNERS, OR AUTHORIZED DISTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE DESKTOPSTREAMER SOFTWARE, EVEN IF KTS INFOTECH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
JURISDICTION.
All disputes arising from the use of DesktopStreamer software, including but not limited to Distribution and Customer Care, will solely be dealt under the jurisdiction of the court of Kerala, Ernakulam or Kottayam District.
